Dell India gets notice for over-pricing products

New Delhi, Aug 2 (IANS) Computer major Dell India has been issued notice by a district consumer court here for allegedly over-pricing products and supplying a faulty laptop to a customer.

A consumer court in Shalimar Bagh, while issuing notice to Dell India earlier this week, asked the firm to file its response by Dec 21, the next date of hearing.

The court was hearing the plea of Archer Softech Pvt Ltd through its advocate Ankur Raheja, who alleged that the Dell Inspiron 6400 laptop it bought for Rs.69,164 turned out to be faulty. He also said that the company was not ready to replace or repair the product.

‘Except the hard-disk and processor (which are of Toshiba and Intel make, respectively), almost each and every part has either been replaced or is not functioning properly due to manufacturing defects and poor quality of spares supplied for the laptop,’ Raheja told IANS.

He added that his client had to run form pillar to post to get spare parts for the laptop and its servicing, which also resulted in loss of business. He has demanded that the company return the amount paid by the consumer for the laptop and a compensation of Rs.400,000.

The complainant also alleged that Dell is over-pricing its products, charging consumers much more than the maximum retail price (MRP).

‘There is no doubt that Dell India’s aim is not just profit but extraordinary profit by exploiting Indian customers. That is why the prices for laptops and especially parts are always charged on the higher side in India,’ Raheja said in the complaint.

He said that the company had charged much more than the MRP for a battery. The cost of the battery, printed on the box, was Rs.2,100 but the company charged Rs.5,152, he alleged.

‘We have contacted the company on many occasions but lame excuses were provided by the irresponsible staff. And on some occasions, no response was received,’ Raheja said.

“Come September, mobile users in metros and larger cities will be able to shift from their existing operators to another operator, retaining their mobile number. The DOT has given the license to MNP Interconnection Telecom Solutions, a Telcordia joint venture company, to roll out the system in two phases in the southern and eastern regions. This facility will initially be rolled out in Tamil Nadu, Andhra Pradesh and Kolkata, and in Karnataka in six months.

To shift from an existing operator, customers will need to submit a request to their operator. “The process has to be completed in a maximum of two days and the mobile phone will be under a de-activated stage for just two hours, during the process,” said Ashok Sapra, MD, MNP Interconnection Telecom Solutions. I hope it is rolled out in Delhi soon, as it will open up the competition and services would improve… and you are free to leave the worst of operators like Reliance Communication.

DELL sells over MRP

Though, no doubt there are lot of decided matters on the issue of MRP, but big MNCs like DELL are not interested…

Archer Softech Pvt Ltd purchased a battery from DELL which was charged as Rs 5,100 and even invoice issued for the same amount but the battery box reads MRP as Rs 2,100 (inclusive of all taxes).

Further, the legal notice served on this behalf has been returned as quoting “REFUSED to ACCEPT”.

Upgraded to Adobe Design CS4

Recently upgraded to licenced version of Adobe Design CS4, which includes Photoshop, Flash, Dreamweaver, Indesign, Illustrator and more i.e. all required for a perfect web design. Previously, I had licenced version of Macromedia MX 2004. Upgrading was cheaper from US, as $200 extra discount was available in North America and there are no geographical restrictions as disclosed by Adobe Customer Care.

The product had some free benefits like two issues of Layers Magazine were provided free… otherwise also LayersMagazine.com has lot of Free Video tutorials… ofcourse best resource to learn about new features of CS4 products…

Won against CitiBank…

Also won a case against CITIBank in January 2009, they have to pay me Rs 12,000 for harassment caused by over-charging in my father’s Credit Card statement. Worst part was other Opposite Party “Infomedia India Limited” was allowed to go scott free… but atleast it was proved who was the wrong doer out of two !

Have already few other issues against CitiBank… so another proceedings will start soon for Defamation and Harassment… as the above case proves that they had wrongly charge us, which they already had reversed after legal proceedings and legal notices. BUT these scoundrels used to call us early in the morning at 7 AM asking for money that also by asking for Mr V.K. Raheja, who had already expired few months back and they even had Death Certificate in their record.

WHAT a shameless multinational Bank… worst than ICICI !!!

Reliance Infocomm Case…

Reliance Case is still on… its been around 4 years since the battle started, i.e. May 2005. And now the case will be back in District Forum on 20th April 2009… Reliance will surely have to cough out more, unless ofcourse my case file goes missing. Though surely by the time decision comes… it will almost a record for a consumer case in the District Forum.

Though, Consumer Law provides that under Section 13(3A) as follows:

” (3A) Every complaint shall be heard as expeditiously as possible and endeavour shall be made to decide the complaint within a period of three months from the date of receipt of notice by opposite party where the complaint does not require analysis or testing of commodities and within five months if it requires analysis or testing of commodities:
Provided that no adjournment shall be ordinarily granted by the District Forum unless sufficient cause is shown and the reasons for grant of adjournment have been recorded in writing by the Forum:

Provided further that the District Forum shall make such orders as to the costs occasioned by the adjournment as may be provided in the regulations made under this Act.

Provided also that in the event of a complaint being disposed of after the period so specified, the District Forum shall record in writing, the reasons for the same at the time of disposing of the said complaint. ”

BUT WHO CARES !!!

Windows Vista/Fedora 9 dual boot

Finally shifted to FEDORA 9 from Fedora 6… but as soon as I installed Fedora, VISTA stopped booting… “MISSING BOOTMGR” error !
